When will the ban on texting while driving hit the PEO arena?

I am waiting to see the first case of a workers comp carrier denying coverage of a claim because an employee was doing something illegal…aka driving while texting…during the course of work. I wonder how a PEO will handle this?

I am no longer in the PEO business, except as a provider of HR products and services to PEOs and ASOs; however, after ten years, I’d say liability may be determined by several issues: what’s in the EE handbook, risk management training, the purpose of the texting (message sent from employer to employee, for instance), language in the WC policy.

    No matter what, it may be messy.
